1. Tourists are advised to carefully read all the terms and conditions of this contract before signing, especially those highlighted in black font that require special attention from tourists
2. This agreement applies to all independent travel products of group tours, and does not apply to platform based semi independent travel products that cooperate with group tours and third-party suppliers with legal qualifications. For such products, tourists will directly sign outbound travel contracts with third-party suppliers
3. "Tourism services" refer to self guided tours where tourists entrust group tours to handle two or more affairs (such as airfare and hotels) and travel to their destination on their own. This service method is different from package tours and group tours. Unlike group tours, it is only responsible for the content entrusted by the tourist, and does not arrange travel itineraries or dispatch leaders. It is not responsible for matters outside of the entrusted content, and non entrusted matters are arranged by the tourist themselves. This contract does not apply to the relevant provisions of laws and regulations regarding group travel agencies
4. Tourists purchasing group travel products should be a personal act without any commercial purpose. If a tourist purchases the products agreed upon in this contract for commercial purposes, regardless of the stage of the transaction, the group tour has the right to immediately cancel the transaction and deduct the losses incurred during the process from the fees already paid by the tourist. The remaining amount will be refunded to the tourist
5. The tourist agrees that Beijing Shengjia Technology Co., Ltd., a member of the group tour group, has the right to designate a third party to fulfill its obligations and exercise its rights under this contract. Beijing Shengjia Technology Co., Ltd., a member of the group tour group, is a qualified tourism service provider providing outbound tourism services and operates tourism services under this agreementContract Terms
Client (Tourist): Referring to the order information, the ordering user signs this agreement on behalf of all travel users in the order.
In accordance with relevant laws and regulations such as the Contract Law of the People's Republic of China and the Tourism Law of the People's Republic of China, the client and the trustee have reached the following agreement on an equal and voluntary basis regarding the client entrusting the trustee to book flight tickets, hotels, visa processing, insurance, WIFI equipment rental or other service items required by tourists for group tours:
1. Tourist Information and Their Documents
1.1 Referring to the tourist information displayed in the order submitted by members of the group tour on the group tour platform, both the tourist and the order filler promise that the information provided is true, accurate, and reliable Effective. Any risks caused by changes in tourist information will not be borne by group tours
1.2 This contract is a commission agreement between the tourist who agrees to book a group tour product (regardless of whether they actually participate in all or part of the tourism activities) and the group tour
1.3 If the person who booked the product for a group tour is different from the person who actually used the corresponding product, the person who booked the product should have obtained authorization from the person who actually used the corresponding product to make the reservation and agree to assume this contract and related obligations. There is reason to believe that the person who booked the product with the group tour has obtained the above authorization when making the product reservation, and is willing to assume some of the obligations of the tourist in this contract
1.4 The tourist understands and agrees to all the contents of this contract and its related annexes. And confirm that the entrusted matters are correct
1.5 Special reminder for group travel: Tourists should pay attention to the clauses highlighted in black and underlined in this contract that require special attention, and carefully read all the contents of this contract
1.6 Both parties to this contract shall contact each other through the contact information provided by the tourist for the order contact person. The tourist agrees to confirm by phone, email, or SMS. If there is a change in the contact information of the order, two working days' notice should be given in advance and the updated contact information of the order should be provided again through the requirements of the group tour. Otherwise, the losses caused by this shall be borne by the defaulting party 2.1 Group Tour provides tourists with two or more service items, including agency booking of air tickets, hotels, visa processing, shuttle services, and tour guide services. The specific delegation matters for each tourist are determined based on the product type and service content they choose while submitting their order 2.2 If a tourist entrusts a group tour to handle the above-mentioned affairs for the commercial purpose of resale without the consent of the group tour, the group tour has the right to hold the tourist legally responsible, and the tourist must repay any direct or indirect economic losses caused to the group tour and its related partners 2.3 Entrustment Handling Process 2.3.1 The services available for booking on group travel websites are divided into two types: "immediate confirmation" and "secondary confirmation". The remaining quota for the "immediate confirmation" service, also known as the "remaining quota", is accurate and updated in real-time. Tourists can pay immediately after placing an order, and successful payment is considered a successful transaction. The "remaining space" of the "secondary confirmation" product is for reference only. Tourists cannot pay immediately after placing an order and need to contact the tour staff for confirmation before payment can be made. Successful payment is also considered a successful transaction 2.3.2 Tourists can click "Book Now" on the group tour website for services that can be booked for group tours. After entering relevant information according to the system prompt and clicking "Submit Order", the order will be generated, and the "remaining space" of the service will be automatically reduced by the corresponding quantity. Each order is provided with a unique order number for inquiry. After each order is submitted, travelers must complete the payment within 120 minutes (the actual payment time for purchasing goods is subject to the actual payment time). If the deadline is exceeded, the system will automatically cancel the order, and the "remaining space" of the service will be automatically restored. If there is a delay in the system or payment is successful through a third-party payment platform, the status of this order will be subject to the final notification from the group tour to the tourist 2.3.3 Tourists should upload their passport homepage to the designated group travel website system no later than 10 days before departure (if indicated on the group travel page or notified by customer service personnel, please refer to the page indication or customer service notification). Please indicate the corresponding order number and tourist name in the email title (it is recommended to use the format of "Tourist Name - Order Number"). The order number can be found on the "My Orders" section of the group travel website. If the inability to travel or related losses occur due to the tourist's failure to provide passport information in a timely manner or incorrect passport information, the group travel website will not be held responsible 3.1 Rules for Ticket Booking 3.1.1 The signing, transfer, and refund of tickets must be handled in accordance with the regulations of the airline company. Discounted tickets applied to airlines through group tours usually come with strict restrictions. Tourists are advised to pay attention to and comply with the following: (1) After the order is successfully submitted, the name, ID number, date, and flight cannot be changed (2) For any flight ticket that requires a deposit to be paid by the group tour to obtain from the airline, even if the ticket has not been issued, if the reservation is cancelled, the group tour will incur a loss of deposit, which will ultimately be borne by the cancelled tourist (3) The ticket price (or electronic itinerary) may not match the ticket price, and travelers should understand the commercial operations of the airline. Tourists can request an official fee from the group tour that is equal to the actual payment amount (4) Airlines usually determine the amount of aviation tax based on the exchange rate at the time of ticket issuance. If the actual aviation tax is higher than the advance payment due to exchange rate changes, tourists must make up the difference (5) If the tourist's ticket is a round-trip or connecting ticket, the ticket must be used in order, otherwise the airline has the right to cancel the tourist's subsequent itinerary; If a tourist experiences a NO-SHOW (failure to board on time) during certain flight segments, the cost of the missed segment cannot be refunded. If the tourist is unable to enjoy other related services on time due to their own reasons, they will bear the cost themselves. The corresponding fee will not be refunded for group tours (6) The method of purchasing air tickets from airlines for group tourism is different from that of booking air tickets for regular individual travelers, so the calculation method for airport construction fees and fuel taxes is different from that of booking air tickets for regular individual travelers (7) Booking flight tickets with group tours is a discount and does not accept services such as changes, transfers, refunds, etc 3.1.2 Special Rules for Flights (1) Flights are usually ticketed on the day before or on the day of departure, and travelers should determine their own flight number and schedule. The "+1" in the flight takeoff and landing time displayed on the group travel website indicates that the landing time of the flight has been changed to the day after the departure time (2) Air luggage is allocated according to airline rules. For flight segments that do not include checked in items, customers need to purchase them themselves. Group tours do not bear any differential losses caused by customers' failure to consult or purchase in a timely manner 3.1.3 The flight and aircraft information displayed in the product is for reference only, and the final information is subject to travel notifications. Other flights may be delayed or cancelled due to weather and other reasons. Tourists should pay real-time attention to flight changes, communicate closely with their airline, and maintain smooth information flow. Traveling with a group tour does not assume any responsibility for this. If compensation is obtained according to the notification of the airline, the group tour will reasonably assist the tourists in obtaining corresponding compensation but will not assume any other additional responsibilities 3.2 * * * * and check-in rules 3.2.1 Domestic hotels usually require tourists to check out before noon and check in after noon; International hotels usually require check-out procedures to be completed before 12 noon and check-in procedures to be completed after 2 pm. Some international hotels have check-out times before 12:00 noon. Tourists are advised to inquire about the specific situation when checking in at the hotel. If the reservation exceeds the time limit, an additional fee will be charged (if the check-in is in the early morning of the second day after the booking date, it will also be counted as one day and an extension fee will be charged). Except for a few hotels or special holidays, tourists should handle it according to the rules of the corresponding hotel. If the guest does not check in according to the check-in date, they will not be able to check in based on a successful reservation, and the group tour will not be responsible for corresponding coordination or additional arrangements Tourists should arrange their itinerary reasonably based on this. For hotels that indicate "breakfast included" in the product details, breakfast is generally arranged according to the number of beds. Therefore, children who do not occupy beds may not have their own exclusive breakfast 3.2.2 Due to environmental considerations, some hotels do not traditionally provide toiletries and slippers, and must bring their own; There may not be hot water supply in the room, but if you have a habit of drinking tea, the breakfast restaurant will have hot water supply. Some guest rooms are equipped with electric water bottles, and you can also bring your own electric water bottles for use, but be sure to pay attention to safety<3.2.3 The power sockets in the regions where tourists purchase products may differ from those in China. It is recommended to prepare multifunctional conversion sockets Tourists should familiarize themselves with the payment methods for some of the fees charged by the hotels they stay in before using them. This may include but is not limited to pay television, telephone, beverages, etc. Check in, check-out, early check-out due to unforeseen circumstances, and extension of stay must be handled in accordance with the hotel's regulations. Most hotels require guests to pay a deposit upon check-in. If checking in early or checking out late, the hotel may charge additional fees at its discretion. Tourists and hotels are requested to handle these matters on their own 3.2.4 The hotel information and pictures displayed in the product are for reference only. The hotel star rating is based on the evaluation criteria of the local hotel at the destination, and the actual stay shall prevail. According to the laws or industry regulations of the country and region where the hotel is located, most overseas hotels do not conduct star rating standards. Group tours are only booked according to the level standards specified or selected by the tourist when submitting the order to the group tour. The group tour reminds tourists to pay attention to the hotel's equipment, facilities, usage methods, etc., to ensure correct and reasonable use, but is not responsible for the hotel's facilities, equipment, or service matters 3.2.5 If tourists change or cancel their reservations, they must follow the regulations on canceling or changing reservations for group tours and the relevant regulations on changing reservations for hotels. Tourists should bear the losses or liquidated damages caused by changes or cancellations 3.2.6 If a tourist chooses to travel with a group tour for round-trip airfare products, the group tour does not assume any responsibility or risk related to the tourist's hotel stay 3.2.7 To ensure the personal and property safety of tourists, group tours do not provide or recommend strangers to share the same hotel room. If there are personal safety issues or property losses caused by tourists sharing rooms with others, group tours do not assume any responsibility 3.3 Shuttle Service Rules 3.3.1 Shuttle service (if any), only refers to providing one-way or round-trip transportation from the airport to the hotel (or agreed location), excluding tour guide and tour guide services 3.4 Visa Rules 3.4.2 According to the regulations of the embassy (consulate), group tours shall inform tourists in writing of the necessary documents for visa application. If there are any changes in the embassy's requirements, group tours will notify tourists in a timely manner, but group tours are not responsible for any change requests made by the embassy (consulate) 3.4.5 When entering certain visa free or visa on arrival countries or regions, travelers are required to present * * * documents, return tickets, etc. to immigration officials, and are advised to bring them with them 3.5 Rules for Individual Travel 3.5.1 The departure, destination, and travel time of individual travel shall be based on the information displayed on the group travel website. If the website indicates a reference flight and hotel, the flight and hotel introduction information, including text, pictures, etc., is for reference only. The final flight and hotel information shall be based on the group travel departure notice 3.5.2 When traveling with a group, please send the corresponding free flight time to the email provided by the tourist in the form of an email before the tourist departs. Please check your inbox carefully 3.5.3 Calculation method for specific travel days/nights for independent travel: Calculate the natural days based on the local departure time of the departure flight (or cruise or other transportation) and the arrival time of the return flight (or cruise or other transportation) at the destination. If it exceeds 00:00 on the same day, it is considered as one day. Calculate the number of nights based on the number of nights spent in hotels (or cruise ships) at the tourist destination. If departing on March 1st, arriving on March 2nd, returning on March 5th, and arriving on March 6th, it will be 3 nights and 6 days/or 4 nights and 6 days (subject to the product information announced by the group tour) It is recommended that tourists undergo a comprehensive physical examination before traveling. Patients with the following health problems should not travel: (1) Patients with infectious diseases, such as infectious hepatitis, active tuberculosis, typhoid fever, etc (2) Patients with cardiovascular diseases, such as severe hypertension, heart failure, myocardial hypoxia, myocardial infarction, etc (3) Patients with cerebrovascular diseases, such as cerebral embolism, cerebral hemorrhage, brain tumors, etc (4) Patients with respiratory system diseases, such as emphysema, pulmonary heart disease, etc (5) Psychiatric patients, such as epilepsy and various psychiatric patients (6) Patients with severe anemia, such as those with hemoglobin levels below 50 grams per liter (7) Recovery period patients undergoing large and medium-sized surgeries (8) Pregnant women and those with limited mobility 4.3 If the tourist is over 70 years old (inclusive) or under 18 years old (exclusive) when signing the contract or during the travel period, they should have the consent and accompaniment of an adult and fully capable person. Tourists who are pregnant, have physical disabilities, or are non Chinese nationals (including Hong Kong, Macau, and Taiwan) when signing this contract should be clearly informed to the group tour and sign relevant documents according to the requirements of the group tour. The group tour has the right to refuse such tourists from signing the contract. If a contract is signed without prior knowledge of such circumstances, the tour group has the right to immediately terminate the contract, and the consequences shall be borne by the tourist themselves 4.4 Reminder for Group Travel: Women of childbearing age should confirm before signing this contract that their travel period is not during pregnancy. If they request to terminate or change the contract due to pregnancy, they should bear the relevant responsibilities according to the provisions of the contract regarding termination or change due to the tourist's reasons.
